We care about your rights, including the right to file a complaint. Below you will find detailed information regarding our liability for defects in the product sold by us and your rights related to the complaint under statutory provisions – due to non-conformity of goods with the contract.

The basis and scope of our liability for product defects due to non-conformity of goods with the contract are determined by generally applicable legal regulations in force from January 1, 2023, in particular the provisions of the Act of November 4, 2022, amending the Act on Consumer Rights, the Civil Code, and the Act on Private International Law. For goods purchased before January 1, 2023, the rules for complaints under the warranty apply.

We are obliged to deliver a product without defects. We are liable for non-conformity of goods with the contract if a physical defect of the product is found before the expiry of two years from the date of its delivery to the buyer. Important! We are liable for non-conformity of goods with the contract for physical defects that existed at the time the risk passed to the buyer or resulted from a cause inherent in the item sold at the same time.

The goods are in conformity with the contract if, in particular, they:

1. correspond to the description, type, quantity, quality, completeness, and functionality, and in the case of goods with digital elements – also compatibility, interoperability, and availability of updates,

2. are suitable for any particular purpose for which the consumer needs them and which the consumer made known to the trader at the latest at the time of the conclusion of the contract and which the trader has accepted.

Furthermore, to be considered in conformity with the contract, the goods should:

1. be fit for purposes for which goods of the same type are normally used, taking into account applicable laws, technical standards, or good practices,

2. be in the quantity and have the qualities, including durability and safety, and in the case of goods with digital elements – also functionality and compatibility, which are typical for goods of the same type and which the consumer can reasonably expect,

3. be supplied with accessories and instructions which the consumer can reasonably expect to be provided,

4. be of the same quality as a sample or model that the trader made available to the consumer before the conclusion of the contract and correspond to the description of such sample or model. The consumer's reasonable expectations regarding the goods take into account the nature of the goods and any public statements (e.g., in advertising or on labeling) made by the seller (including their predecessors in law or persons acting on their behalf), unless the seller proves that:

- they were not aware of the given public statement and, assessing reasonably, could not have been aware of it,

- before the conclusion of the contract, the public statement was corrected in the manner in which it was made or in a comparable manner,

- the public statement did not affect the consumer's decision to conclude the contract.

Legal basis: Article 43b of the Consumer Rights Act.

In the event of non-conformity of the goods with the contract, the consumer may file a complaint with the seller and request:

1. repair of the goods,

2. replacement of the goods.

If the seller:

- refused to repair or replace the goods,

- did not repair or replace the goods,

- attempted to repair or replace the goods, but they are still non-conforming,

- declared that they would not repair or replace the goods within a reasonable time or without significant inconvenience to the consumer,

then the consumer has the right to demand a price reduction or – in case of significant non-conformity – to withdraw from the contract. If the non-conformity with the contract is significant, the consumer may demand a price reduction or withdraw from the contract without first requesting repair or replacement.

In the description of the complaint, please describe the noticed non-conformity of the goods with the contract and specify your demand provided for under the non-conformity of the goods with the contract.
