CONTEST TERMS AND CONDITIONS "Contest 2024 Tell us..."

§1 GENERAL PROVISIONS

  1. The organizer of the contest titled "Contest 2024 Tell us..." (hereinafter: the "Contest") is:

  2. The sponsor of the prizes in the "Contest 2024 Tell us" contest is GAPI Sp. z o.o. | ul. Hoża 86/410, 00-682 Warsaw, Poland, NIP 7011068399 | KRS 0000945496 | REGON 520952732, e-mail: sklep@table4u.pl (hereinafter: the "Sponsor").
  3. The owner of the portals www.facebook.com and www.instagram.com is not the organizer or co-organizer of the Contest.
  4. The Contest is organized according to the rules set forth in these terms and conditions (hereinafter: the "Terms and Conditions") and in accordance with the generally applicable laws.
  5. The Contest is not a gambling game within the meaning of the Gambling Law of November 19, 2009 (Journal of Laws 2009, No. 201, item 1540, as amended).
  6. Participation in the Contest implies the Contest Participant's consent to the provisions of the Terms and Conditions and acceptance of the rules of the Contest as described in the Terms and Conditions. By participating in the Contest, the Participant confirms that they meet all the conditions entitling them to participate in the Contest and consents to the processing of personal data to the extent necessary for the Contest.
  7. The rules of the Contest are set out in the provisions of the Terms and Conditions, which do not exclude the rights granted to Participants under separate laws.

§2 CONTEST DURATION AND LOCATION

  1. The Contest is conducted within the territory of the Republic of Poland, in the cities where, according to the information presented on the Organizer's online store, products are delivered - on the profile at the address: https://www.facebook.com/table4Upl/ (hereinafter: the "Profile").
  2. The Contest begins with the publication of the contest post on August 14, 2024. Submissions will be accepted until August 31, 2024, at 11:59 PM.

§3 CONTEST PARTICIPANTS

  1. A Contest Participant may be a natural person of legal age, having full legal capacity, who is a consumer within the meaning of Art. 221 of the Civil Code, residing in the territory of the Republic of Poland, and having an active account on the portal: facebook.com or Instagram.com (hereinafter: the "Participant").
  2. Employees of the Organizer and Sponsor, as well as other persons cooperating in the organization of the Contest, and their ascendants, descendants, spouses, parents of spouses, siblings, and persons in a relationship of adoption with them, may not participate in the Contest.
  3. Participation in the Contest is voluntary.

§4 CONTEST RULES

  1. To participate in the contest, the following conditions must be met:
  2. Submit a task involving sharing a personal photo, created visualization, or moodboard with Table4U.pl furniture on your profile, Instagram story with the hashtag #tellus and tagging the @table4u.pl profile, or posting it in a comment under the contest post on Facebook.
  3. Send the published photo, moodboard, or visualization to the email address info@table4u.pl, with the subject line: "Contest 2024 Tell us..."
  4. Performing the Contest Task in accordance with the provisions of § 4 sec. 1 and 2 above constitutes the submission of participation in the Contest.
  5. A Participant may participate in the Contest multiple times and perform the Contest Task several times.
  6. Participation in the Contest is free of charge.
  7. Participants are not entitled to any remuneration for participating in the Contest.
  8. The Contest Task must be exclusively the Participant's work and must not violate the rights or personal interests of third parties.
  9. Contest Tasks that: a. violate applicable laws, including copyright and trademark rights, industrial designs, utility models, or are not exclusively the Participant's work, call for racial, religious, or ethnic hatred, or contain fascist, pornographic, or generally vulgar content, promote violence, offend religious feelings, or good customs, b. contain personal data, contact details, email addresses, GG, Skype numbers, etc., c. are contrary to the regulations of facebook.com or instagram.com, will not participate in the Contest.
  10. The Contest Organizer reserves the right to use Contest Participants' photos for their own marketing communication for an indefinite period. Not all contest entries will be used by the organizer.
  11. Supervision of the proper conduct of the Contest is exercised by an internal committee (hereinafter: the "Committee") appointed by the Organizer, composed of: a. Chairman of the Committee; b. Committee member; c. Secretary of the Committee.
  12. The Committee meeting, during which 3 (three) Contest winners (hereinafter: the "Winners") will be selected, will be held on September 6, 2024, at 10:00 AM. The deliberations are not public and take place at the Organizer's headquarters. The Committee prepares a protocol of its deliberations.
  13. The criterion for selecting the winning Contest Task is the originality of the story presented by the Participant.
  14. The Contest results will be announced to the public within 14 days from the end of the submission period by being posted in a comment under the contest post on the Profile, stating the Winner's name and surname, or the nickname used by the Winner on the portal: facebook.com or instagram.com. The winners will also be notified directly (e.g., via social media message or email).

COMPETITION REGULATIONS “Competition 2024 Tell us…”

§5 PRIZES

In the competition, the Jury will select 3 winners, prizes (hereinafter "Prize"):
A one-time discount of 20%, 25%, 30% on purchases at Table4u store valid for 3 months from the date of delivery. Additional prize - Gubbe table - sizes 100x50 or 80x60, and the color of your choice.

  1. The Competition Winner is not entitled to transfer the right to receive the Prize to third parties.
  2. The Prize is not exchangeable for a cash equivalent or subject to commercial trade.
  3. The condition for awarding the Prize to the Winner is the submission by the Winner to the Organizer, no later than within 7 days from the announcement of the Competition results, of the necessary data for shipping purposes, including contact details, residential address, delivery address, email address, and phone number. The data should be provided via a private message sent through the www.facebook.com or Instagram portal from the same profile that submitted the winning Competition Comment or via email.
  4. The Winner loses the right to the Prize in the event of failure to provide the Organizer with the information mentioned in §5, point 3 above, or non-compliance with the Regulations. In each of these cases, the Organizer notifies the Winner of the loss of the right to the Prize through a private message via the www.facebook.com portal. In the event of the Winner losing the right to the Prize, it reverts to the Organizer.
  5. The Prize will be awarded within 30 days from the date of providing the Winner’s details as mentioned in §5, point 4 above.

§6 PARTICIPANT STATEMENTS

  1. The Competition Participant declares that: a) they are the sole author of the Competition Task and hold full copyright to it, b) no third parties hold any rights or claims to the Competition Task, c) the Competition Task is not a derivative or adaptation of another work within the meaning of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws 2006, No. 90, item 613, as amended), d) the Competition Task does not infringe any protective rights within the meaning of the Act of 30 June 2000 (Journal of Laws 2017, No. 776, as amended as of 2017.04.13) Industrial Property Law, e) the Competition Task does not infringe any third-party rights, f) there are no other circumstances that could expose the Organizer to liability towards third parties due to the use of the Competition Task.
  2. The Participant declares that they have read and understood the Competition Regulations on the website http://table4u.pl

§7 COMPLAINT PROCEDURE

  1. The Commission is responsible for handling complaints received from Competition Participants.
  2. All complaints and objections regarding the course of the Competition should be submitted by Participants in writing within 14 days from the date of the Competition results announcement. The date of receipt of the complaint submission is decisive in determining the deadline.
  3. Complaints should include the note “Complaint – Competition 2024 Tell us” and contain the Participant’s name and surname, Participant’s address, the date and place of the event to which the claim refers, and the content of the claim.
  4. Submitted complaints will be processed promptly, but no later than within 14 days from the date of their receipt.
  5. In processing complaints, the Commission relies on the content of the Regulations and applicable laws.
  6. The complaint procedure does not deprive the Participant of the right to seek claims in common courts.

§8 PERSONAL DATA

  1. The administrator of personal data collected during the Competition is the Organizer, i.e., GAPI Sp. z o.o. with its registered office in Warsaw.
  2. Competition Participants consent to the use and processing of personal data provided to the Organizer in connection with the organization of the Competition.
  3. GAPI Sp. z o.o. with its registered office in Warsaw hereby informs that personal data provided (submitted) in connection with the organization of the Competition are processed for the following purposes:
  4. for participation and conduct of the Competition, announcement of the Competition results, awarding the Prize, handling complaints, for tax and accounting purposes, and the performance of other obligations arising from the Regulations, and in connection with this purpose (these purposes): a) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as "GDPR"), (ii) the provision of consent for the processing of personal data is voluntary but necessary to participate in the Competition, to award the Prize, to announce the Competition results, to handle complaints, for the tax and accounting purposes mentioned in the Regulations, (iii) recipients of personal data are or will be entities authorized to obtain personal data based on legal regulations and the Organizer, Sponsor, cooperating entities, and service providers supporting the storage of personal data, server providers, entities cooperating in the organization of the Competition, (iv) personal data will be stored and processed until the expiration of all possible claims arising from the Competition, (v) the processing includes: first name(s) and surname, nickname, phone number, residential address, delivery address, email address, awarding the Prize, awarding the Prize, participation in the Competition, the date of registration in the Competition;
  5. for marketing purposes, and in connection with this purpose: (i) the legal basis for processing personal data is the consent of the person providing the data - a) GDPR, (ii) recipients of personal data are or will be entities authorized to obtain personal data based on legal regulations and the Organizer, Sponsor, cooperating entities, and service providers supporting the storage of personal data, server providers, entities cooperating in the organization of the Competition, (iii) personal data will be stored until the consent is withdrawn, (iv) the processing includes: first name(s) and surname, nickname, phone number, residential address, delivery address, email address, awarding the Prize, awarding the Prize, participation in the Competition, the date of registration in the Competition, (v) the Participant is not required to consent to the processing of personal data for marketing purposes.
  6. The Competition Participant - in accordance with the Act on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended) and the Telecommunications Law (consolidated text: Journal of Laws of 2017, item 1907, as amended) - may consent to the processing of personal data to receive commercial information from the Organizer or Sponsor by electronic means, SMS, or by phone. The Participant’s consent may be withdrawn at any time.
  7. The Competition Participant has the right to request access to their data and its correction, deletion, and from the date of entry into force of the GDPR, the right to request access to their data, the right to correct, amend, delete, withdraw consent, restrict processing, and the right to data portability in the cases specified in the GDPR.
  8. In cases where the processing of data is based on consent, the Competition Participant has the right to withdraw consent at any time.
  9. Personal data will be processed automatically, including profiling.
  10. The Competition Participant has the right to file a complaint with the supervisory authority if they believe that the processing of personal data concerning the Competition Participant violates the provisions of the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws of 2016, item 922, as amended) or from 25 May 2018 GDPR.

§9 FINAL PROVISIONS

  1. The Regulations come into force on 13 August 2024.
  2. The Regulations are available for download here and at the Organizer’s office.
